The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that up to 14 days after receiving your goods, in most cases, you can change your mind and get a full refund.

  • up to 30 days: if your goods are faulty, then you can get a refund;
  • up to six months: if they can’t be repaired or replaced, then you’re entitled to a full refund, in most cases;

5. Ordering goods from us

Below, we set out how a legally binding contract between you and us is made.

You place an order on the site by completing our order form. Please read and check your order carefully before submitting it. However, if you need to correct any errors you can do so before submitting it to us.

Simply add products to your shopping cart, click checkout, enter your information and purchase with your credit card , pay pal or Afterpay account. Once successfully submitted you will be taken to a successful checkout page and receive your order confirmation via email. If you have set up an account you will be able to see your order history and status within your "my account portal". If you’re not happy with your order, please tell us via the returns enquiry form on our website – we’ll always try to help you if we can.

If you’ve have opened and consumed a portion of the product, no refund or exchange can be given.

6. Right to cancel

You have the right to cancel this contract within 14 days without giving any reason provided you have not opened or consumed a portion of the product or otherwise tampered with the product.

The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

7. Effect of cancellation

If you cancel this contract in accordance with your statutory consumer rights, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

Provided you have not opened, damaged or tampered with the order, we will make the reimbursement without undue delay, and not later than:

  • 14 days after the day we received back from you any goods supplied; or
  • (if earlier) 14 days after the day you provide evidence that you have returned the goods; or
  • if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

If you have received goods:

  • you shall send back the goods, unopened, untampered with and in their original packaging, or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired;
  • you will have to bear the direct cost of returning the goods; and
  • you are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Returns

We want you to love Lyre’s Non-Alcoholic Spirits as much as we do. If you should require a return, refund or exchange you have up to 14 days from the date of purchase, subject to the below:

  • If you haven’t used the product, we’ll exchange it (if the product you received was incorrect) or refund you in full using the same method of payment as your initial purchase.
  • If you’ve have opened and consumed a portion of the product, no refund or exchange can be given.
  • We cannot exchange or refund gift vouchers or promotional items.
  • If you’re not happy with your order, please tell us via the returns enquiry form below –we’ll always try to help you if we can.

8. Delivery

We endeavour to ship your order as soon as possible. Your order should arrive in 3-10 business days by standard shipping. We cannot guarantee or provide a day of the week or time of day for delivery. Shipping on orders of $75 AUD or more are free in Australia (standard shipping only). For orders less than $75, we deliver for $10 AUD Australia wide. Orders placed on our Australian website, www.lyres.com.au, can only be delivered to an Australian address.

We are unable to make changes to orders once placed. Orders are processed very quickly, so if you need to cancel your order please drop us an email at [email protected] immediately. We’ll do our best to help, but, subject to the terms of this contract, we can’t cancel orders once they have shipped. Please contact Customer Care with your order number if you wish to track your order.

9. Australian Consumer Law

This section only applies if you fall within the meaning of ‘consumer’ in the Australian Consumer Law (ACL). You will generally be considered a ‘consumer’ for the purposes of the ACL if you purchase goods or services that cost less than $40,000 or goods or services that cost more than $40,000 but are of a kind ordinarily acquired for domestic, household or personal use or consumption. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • To cancel your service contract with us; and
  • To a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

The benefits provided to you under this agreement are in addition to other rights and remedies available to you under the law

10. Nature of goods

The Consumer Rights Act 2015 gives you certain legal rights (also known as ‘statutory rights’), for example, the goods:

  • are of satisfactory quality;
  • are fit for purpose; and
  • match the description or sample.

We must provide you with goods that comply with your legal rights.

The packaging of the goods may be different from that shown on the site.

While we try to make sure that all weights, sizes and measurements set out on the site are as accurate as possible, and that the colours of our goods are displayed accurately on the site, the actual colours that you see on your computer may vary depending on the monitor that you use.

Any goods sold:

  • at discount prices;
  • as remnants; or
  • as substandard;
  • will be identified and sold as such.

    11. Damage of goods

    • Us to replace the goods;
    • A price reduction; or
    • To reject the goods and get a refund.

    You may be required to provide photographs of the damaged goods so we can investigate the shipping/packaging process to ensure this won’t happen again.

    If there is a problem when receiving your order, please contact us as soon as possible so that we can assist you with the appropriate refund or replacement. To enable the Customer Service team to efficiently address your enquiry, please provide your order number, full name and contact details.

    13. Promotion & terms conditions

    • “Promo Code” means a code that must be entered at checkout on online transactions in order to receive a discount or benefit.
    • Each promo code is subject to (a) the specific terms and conditions stated on the promo code offer and (b) these general promo code terms and conditions. In the event of any inconsistency, the former prevails.

    14. Gift cards & terms & conditions

    • “Gift Card” means an electronic or physical card that has prepaid currency loaded onto it to be spent on Lyre’s products in accordance with these terms and conditions.
    • Online gift cards must be redeemed at www.lyres.com.au.
    • The value of the gift card includes GST.
    • Not redeemable for cash and cannot be used to purchase other gift cards or other tender. Cannot be exchanged.
    • Gift cards will expire 36months from the date of issue, unless expressly stated otherwise.
    • If purchase exceeds the gift card amount, the balance must be paid by other available payment options.
    • Must be redeemed within the validity period.
    • Expired gift cards are not redeemable and gift card amounts will not be refunded or credited when expired.
    • We reserve the right to cancel any gift card for any reason at any time without notice. In such instances we will elect to provide a refund or a replacement gift card.
    • Gift cards are treated like cash. Defaced, mutilated, altered, lost or stolen vouchers will not be replaced, refunded or redeemed.
    • We reserve the right to correct the balance of your gift card if we believe that a clerical or accounting error has occurred.
    • Lyre’s does not accept any responsibility for lost gift cards.
    • Lyre’s reserves the right to verify the identity of the bearer and to change the terms of use at any time without notice

    16. Limit of our responsibility to you

    Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for:

    Losses that:

    • were not foreseeable to you and us when the contract was formed; or
    • that were not caused by any breach on our part;

    • Any other matter,

    If you and we cannot resolve a dispute using our internal complaint handling procedure, we will let you know that we cannot settle the dispute with you.

    This agreement takes effect, is governed by, and will be construed in accordance with the laws from time to time in force in New South Wales, Australia. The Parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

    If you want to take court proceedings, the courts of the part of the United Kingdom in which you live will have non-exclusive jurisdiction in relation to this contract.

    The laws of Australia, Northern America, England and Wales will apply to this contract.
